In this policy, “us”, “our” and “we” or “Forma” refers to Forma Technology Pty Ltd (ACN 668 606 344). Protection of your personal and possibly sensitive information is important to Forma and is required by law. Under the Privacy Act 1988 (Cth) and all related legislation and regulations, the Commonwealth Government regulates the way in which private sector organisations collect, use, disclose and disseminate, keep secure and provide access to personal information. Forma Technology Pty Ltd (Forma) is a private sector organisation and as such we are required to protect your personal information in accordance with the privacy legislations and regulations. This Privacy Policy outlines how we manage your personal information. It also sets out the types of personal information that we keep and for what purposes and how that information is collected, retained, used and disclosed.

Personal information is defined in the Privacy Act and means information and or an opinion about an identified individual, or an individual who is reasonably identifiable.

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy and any other arrangements that apply between us.

Our Website may contain links to third party websites. We are not responsible for the privacy policies of any third parties and we recommend that you review the privacy policy of the relevant third party.

Forma may update this Privacy Policy from time to time so please review it periodically. 

Following changes to the privacy policy your continued use of our services, requesting our assistance through the platform, or the provision of further personal information to us (directly or via an authorised person) after this Privacy Policy has been revised, constitutes your acceptance of the revised Privacy Policy.

Collecting your Personal Information

 

Our software helps construction firms locate & engage appropriately skilled professionals to work on major infrastructure projects. Our software is accessible via our website (www.forma.tech). 

In order to access our website we require that you provide us with your name, email address, telephone number, and any other information that you choose to provide to us, such as your date of birth, and gender. Failure to supply this information may result in Forma being unable to provide our full suite of services. 

In addition, we collect information about you that is not personal information. For example, we may collect non-identifiable data relating to your activity on our Website (including IP addresses) via tracking technologies such as cookies, or we may collect information from you in response to a questionnaire or survey. This information is generally used to report statistics, analyse trends, administer our services, diagnose problems, target, and improve the quality of our products and services. To the extent this non-identifiable information does not constitute personal information, the Privacy Act does not apply and we may use this information for various purposes in accordance with any applicable laws. By using the Website and agreeing to our Privacy Policy, you grant us permission to place and store cookies, or other tracking technologies.

We only collect sensitive information in circumstances where you have consented to the collection of that information, or it is reasonably necessary for, or directly related to the purposes outlined in this Privacy Policy. 

Using and disclosing of your personal information

  • Provide the services you require including periodical notifications regarding bookings / roles, payments, timesheets and relevant notifications;

  • Administer and manage those services, including (if necessary) charging, billing and collecting debts;

In order to deliver the services you require, we may disclose your personal information to organisations outside of Forma. Your personal information is disclosed to these organisations only in relation to us providing our services to you. The relevant organisations and people for disclosure purposes are:

  • As required or authorised by law and regulations, for example, to government or regulatory bodies for purposes related to public health or safety, the prevention or detection of unlawful activities or to protect public revenue.
  • As required to access your personal information held with government agencies or regulatory bodies (such as the ATO) or accredited data recipients (ADR’s) that are authorised to access such information. 

We may also use your personal information in disclosing your personal information to a trusted third party who also holds other information about you. Or alternatively that you consent to us disclosing your personal information too. This third party may combine that information in order to enable it, and us, to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance our service offering to you.

Data Quality And Accuracy 

We will take reasonable steps to ensure that your personal information is accurate, complete and up to date. If you become aware, or believe that any personal information which we hold about you is inaccurate, incomplete or outdated, you may contact us with evidence that the information is inaccurate, incomplete or out of date. If we agree that your personal information requires correcting, we will take all reasonable steps to correct it. Transfer Personal Information 

The personal information that we request from a member is uploaded to and kept on servers that are maintained by Forma or that are maintained by third parties that must meet our privacy requirements. 

Trans-border Data Flows

In the course of our business, we may need to transfer your personal information to servers and service providers located outside Australia. This may include, but is not limited to, data processing and storage by third-party providers such as Stripe Identity for identity verification purposes.

We are committed to ensuring that any trans-border movement of personal information complies with the Australian Privacy Principles (APPs), particularly APP 8, which governs the disclosure of personal information to overseas recipients. By using our services and providing your personal information, you consent to this transfer and acknowledge that:

  1. Overseas Locations: Your personal information may be processed in jurisdictions outside of Australia, including but not limited to the United States, where our third-party providers’ servers are located.
  2. Data Protection: We require our overseas service providers to handle personal information in a way that is consistent with the APPs or equivalent standards of data protection. However, please note that the privacy laws of these jurisdictions may differ from those in Australia.
  3. Risks and Safeguards: While we take reasonable steps to ensure the security of your personal information when transferred overseas, there may be risks if the overseas recipient does not comply with the same privacy obligations that apply under Australian law.
