Commercial Manager
As part of the Australian executive, I worked closely with Office Directors around Australia and Project Leaders and Project Directors on many and varied projects and contracts. I have been responsible for developing and delivering commercial training, contract administration guidance and advice, contract review & negotiation, attending monthly project reviews, risk identification and mitigation, claims preparation, response & resolution and reviewing & enhancing
scopes of service & fee proposals.

Contracts Administrator / Contracts Manager
I have been a key team member responsible for the successful delivery of a range of major and diverse projects including hospitals, multi storey apartments, government facilities and major retail and commercial developments. My roles through all phases of construction from procurement to final accounts for both the head contract and subcontracts included but was not limited to:

Head Contracts

  • Understanding the scope of works, program and rights & obligations under the contract and preparing templates for notices and the like.
  • Preparation and submission of progress claims including all compliance documents necessary as a pre-condition to payment.
  • Site walks and negotiation with the client representative to agree quantum of completed works and values.
  • Liaison with internal finance team to ensure timely invoicing and payment.
  • Submission and negotiation of variations, notices of delay, extensions of time and other notices.
  • Cashflow forecasting and monitoring.
  • Preparation of commercial content for Project Control Group (PCG) meetings and attendance at same.
  • Where required, preparation and submission of dispute notices and negotiation & resolution.
  • Agreement of final account.
  • Regular communication & interaction with client representatives and other stakeholders.

Subcontracts / Consultants

  • Procurement - preparing documents, writing scopes of work / services & calling tenders, tender vetting & interviews, negotiation and preparing recommendations for internal sign off. Tendering in a logical sequence to suit programmed works while considering market conditions.
  • Subcontract preparation, negotiation of terms and conditions and ensuring correct execution.
  • Take receipt of progress claims, check relevant compliance documentation is included. Assess claims, negotiate & agree quantum and value of claim with subcontractors & consultants and ensure timely payment.
  • Assess and negotiate variations, notices of delay, extensions of time, disputes and other notices.
  • Continued and ongoing dialogue with subcontractor representatives and principals.
  • Final account negotiation and preparation & execution of Deeds of Release.

Internal Reporting and Administration

  • Initial budget analysis, set-up and distribution into cost codes. Ongoing monitoring of budget and forecasting (by cost code and holistically), considering elapsed time, cost to date, market conditions, construction progress and cost to complete.
  • Monthly reporting including, letting status, budget review, forecasting & cost to complete, program status, cashflow, variation register & status, extension of time & delay registers & status, payment status and risks and opportunities review.

General

  • My diligence and curiosity regarding contracts has meant I have always collaborated closely with my employer’s legal teams particularly for claim compilation and/or responses and resolution.
  • As part of project teams, I have worked closely with construction managers, project managers, design managers, services managers, coordinators, engineers, site managers and forepersons, always in a collaborative manner to achieve the best outcomes for projects.
  • In the Contract Manager role, I oversaw multiple projects and provided guidance and mentoring to those project teams.
